On this date in 1789, President George Washington signed into law the Federal Judiciary Act. Article III of our Constitution established a Supreme Court and it allowed Congress to establish lower courts as necessary. Written substantially by Senator Oliver Ellsworth, these courts were established as well as the office of Attorney General. The act has been amended a number of times but their envisioned structure of the federal judiciary stands today.
So, here we are. We've had a federal judiciary for 229 years. I doubt George or Oliver envisioned the nominating and approval process of the Senate for Supreme Court justices could be so distorted as it is today. There must be a better way.
